PUBLICATION OF WINNER AND SUBSTITUTE AND VALIDITY CERTIFICATE OF EASYPROMOS


1. ORGANIZING COMPANY OF THE PROMOTION
The Company ECUS CARE, S.L.U. located at Ctra. Valencia s/n 30510 Yecla (Murcia) and identification number B72735715 organizes the draw (hereinafter, “the Promotion”) for promotional purposes, to be carried out via the Internet, exclusively for users residing in Spain, Portugal, and France and of legal age in accordance with the provisions in the participation conditions section.

2. START DATE AND END DATE
The Promotion will start on May 7, 2024, and will end on May 13, 2024.

The Company reserves the right not to carry out the promotional action if, by the date indicated for its end, there have not been more than one hundred (100) purchases registered. Likewise, the Company may extend the termination of the promotional action by two (2) more weeks, with the new end date being May 27.

3. PARTICIPATION REQUIREMENTS AND PROMOTION MECHANICS
It is important to emphasize that participation in the Contest implies unconditional acceptance and respect for the provisions set forth in these Legal Bases.

The participation requirements are as follows:

• Those who reside in Spain, Portugal, and France and are of legal age may participate.
• Only those participants who have made a purchase on the website www.ecuskids.com during the period from May 7, 2024, to May 13, 2024, both inclusive, may participate.
• Each Participant may participate once with the same email. If the Participant has made two purchases with the same email, it will count as a single participation.

4. CONDITIONS OF THE PROMOTION AND PRIZES
1 winner and 1 alternate will be chosen by draw before Friday, May 17, 2024.

The selection of winners and alternates will be carried out randomly through the Easypromos platform. Easypromos is a platform that guarantees the transparency of the draw results and as proof of this issues a validity certificate for each of its draws, the result of which is unalterable by the draw organizer, and which any participating user can request from the organizer.

The winner will receive as a prize: a Wellbeing Pack (e-coffer) from the brand Wonderbox valued at 99.90 €, to redeem for 1 experience for 1 or 2 people among 2200 experiences and valid until August 31, 2027. The experiences will take place in Spanish territory.

The winner may contact the Company within five (5) days from the date on which the resolution of the draw is announced on the brand's social profile through any communication channels (social media, email, chatbot, phone, WhatsApp, etc.). If such contact does not occur within the stipulated time, the turn will pass to the alternate person and, if this person also does not contact, another winner will be assigned through a new draw. The holding of the draw, as well as the awarding of the prize, are subject to current tax regulations.

5. LIMITATIONS
If it is evidenced that any of the participants do not meet the requirements set forth in the Bases, or the data provided to participate are not valid, their participation will be considered null and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.

The following individuals may not participate in the Promotion: (i) Employees working for any of the companies and other legal entities linked to ECUS CARE S.L.U. (ii) Individuals who participate directly or indirectly in the capital of ECUS CARE S.L.U. (iii) Any other individual who has participated directly or indirectly in the organization of this Contest or has been involved directly or indirectly in its preparation or development (agency, suppliers, etc.).

The awarded prize will not be transferable or subject to changes, alterations, or compensations at the request of the Participants, nor can it be exchanged for any other product or for money.

ECUS CARE S.L.U. reserves the right, if there is just cause and prior communication in legal form, to make any changes, suspend, or extend this Promotion.

Any tax or fiscal burden that the acceptance of the prize may entail will be borne by the winner, as well as any other expenses derived from the promotion that are not expressly assumed by ECUS CARE S.L.U. in these Legal Bases.

A period of fifteen (15) calendar days is established from the date of the award of the prize to make any motivated claim. ECUS CARE S.L.U. reserves the right, in case of necessary obligation, to substitute the prize for another of similar characteristics.

6. DISQUALIFICATION
Any attempt to hinder the proper development of the Contest, whether by human intervention or by an automated process, will result in the immediate disqualification of the participant, nullifying their application.

7. DISCLAIMER OF LIABILITY
By way of example, but not limited to, we are not responsible for possible losses, thefts, delays, or any other circumstances attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use that the participant makes of the prize obtained from this Promotion, and we assume no liability for any damage or harm of any kind that Participants, winners, or third parties may suffer.

We do not assume responsibility in cases of force majeure or fortuitous events that may prevent the execution of the Promotion or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to detected fraud, technical errors, or any other reason beyond the control of ECUS CARE S.L.U. that affects the normal development of the Promotion, we reserve the right to cancel, modify, or suspend it, including the participation website.

8. PERSONAL DATA PROTECTION

ECUS CARE S.L.U. takes the protection of your privacy and personal data very seriously. Therefore, your personal information is kept secure and handled with the utmost care.

In accordance with the provisions established in the applicable regulations regarding data protection, and specifically in Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data, each Participant, by accepting these Legal Bases, consents to the personal data provided for participation in this contest being incorporated into a file owned by ECUS CARE S.L.U. to process participation in the contest and to inform them of the prize in case they win.

Participants guarantee that the personal data provided is true and are responsible for communicating to ECUS CARE S.L.U. cannot be held responsible for any modifications to these. ECUS CARE S.L.U. reserves the right to exclude from this promotion any Participant who has provided false data. It is recommended to exercise maximum diligence in data protection by using security tools, and ECUS CARE S.L.U. for illegal data theft, modifications, or losses.

Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the limitation of the processing of their data, (iv) object to the processing of their data, and (v) request their portability. Without prejudice to any other administrative resource or legal action, the Participant has the right to file a complaint with a Control Authority, particularly in the Member State where they have their habitual residence, place of work, or place of the alleged infringement, in case they consider that the processing of their personal data is not in accordance with the regulations, as well as in the case of not seeing their rights satisfied.

The Control Authority to which the complaint has been submitted will inform the complainant about the course and outcome of the complaint.

9. CHANGES
We reserve the right to modify or expand these promotional bases, to the extent that it does not harm or undermine the rights of the participants in the Promotion.

10. APPLICABLE LEGISLATION AND JURISDICTION
These legal bases will be governed in accordance with Law 13/2011, of May 27, on the regulation of Gambling. The Courts and Tribunals of the Participant's city will be competent to resolve any claim or controversy that may arise regarding the validity, interpretation, or compliance with these bases.
